1. Who we are
Property Deeds USA is operated by Tchoice BV, Arnhemseweg 2, 3812 CH Amersfoort, the Netherlands, registered with the Dutch Chamber of Commerce (KVK) under number 93292058 ("we", "us").
Property Deeds USA is a private company, not affiliated with any county or government agency. We are not a county recorder, clerk or assessor, and we don't provide certified copies.
2. Scope
These terms apply to every use of the website, every account and every order. By using the site or placing an order, you accept these terms. Other terms, such as your own purchase conditions, do not apply unless we agree in writing.
3. Our services
- Free searches: deed history and property information from public open data, where available.
- Deed Copy: we locate the requested recorded deed and deliver a non-certified digital copy.
- Property Title Report: a summary of recorded documents for a property based on public records available to us.
You can often get a non-certified copy yourself from the county, for example from the Cook County Clerk for $5 per document. Our fee covers the time and work of finding, explaining and delivering the document.
4. Information and no guarantee
Information comes from public records and may be incomplete, outdated or contain errors made at the source. We don't guarantee accuracy or completeness. Our services are not title insurance, a title commitment, an abstract of title, a survey or legal advice. For legal decisions, consult a licensed attorney or title company.
5. Permitted use
We are not a consumer reporting agency. You may not use our information as a consumer report under the US Fair Credit Reporting Act (FCRA), including for tenant, employment, credit or insurance screening. You also may not use the site to harass or stalk anyone, for any unlawful purpose, or to copy our site or data in bulk using automated tools. We may refuse orders or close accounts when we suspect misuse.
6. Accounts
You must give correct details and keep your password secret. You are responsible for activity under your account. You can close your account at any time.
7. Orders and prices
Prices are shown in US dollars on the site at the time of ordering. An agreement is formed when we confirm your order. We start work after payment is received. Delivery times are estimates in business days and are not guaranteed deadlines, because they depend partly on county systems.
8. Refunds
If we can't locate the requested document, we'll refund your payment in full. Digital documents are made for your specific request; by ordering, you ask us to start right away and you agree that your right of withdrawal ends once the document has been delivered. If you are a consumer in the EU and we haven't started yet, you can cancel within 14 days for a full refund.
9. Complaints
Not happy with an order? Contact us via our contact page within 30 days of delivery. We aim to respond within 5 business days and will work with you to find a solution.
10. Liability
To the extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential damage, such as lost profit or decisions made based on the information. This limitation does not apply in case of intent or gross negligence, or where mandatory consumer law says otherwise.
11. Intellectual property
The design, text and software of the site belong to Tchoice BV. Public record data itself is not owned by us. You may use documents you order for your own purposes.
12. Privacy
We handle personal data as described in our Privacy Policy.
13. Changes
We may change these terms. The version in force at the time of your order applies to that order.
14. Applicable law and disputes
Dutch law applies. Disputes go to the competent court in the Midden-Nederland district, unless mandatory law gives you, as a consumer, the right to use the courts or law of your country of residence.
